Policies

At JB Racing Products, we take pride in the high quality of workmanship and materials used in the
manufacture of our products. While we make every effort to ensure our products are free of defects in
both materials and workmanship, there is no warranty, expressed or implied for any products used in high
performance and/or racing applications. The customer assumes all liability and risk arising from the
proper installation and use of any high performance and/or racing product.

Otherwise, JB Racing Products warrants only the parts it manufactures and extends no warranty of any
kind, expressed or implied, to parts not manufactured by the company. The company’s obligation under
this warranty is limited to the original Purchaser only, for parts replacement or repair, at its option, found
by the company to be defective, within thirty (30) days after delivery. Such parts are to be returned to the
company with all transportation charges, taxes, imposts, duties, or excise taxes prepaid. Prior to returning
any parts, please contact us for a return authorization number and include this number on the outside
shipping label. This warranty shall not in any way apply to or cover any materials that are, in the
company’s opinion, damaged due to alteration or repair by others, or subject to misuse or negligence.
JB Racing Products shall not pay or cover the cost for labor or parts replacement, adjustments, repairs, or
any other work, unless such charges are pre-authorized in writing by the company.

JB RACING PRODUCTS MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR
IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR
ANY PARTICULAR PURPOSE. JB RACING PRODUCTS SPECIFICALLY EXCLUDES AND
DISCLAIMS ANY AND ALL REPRESENTATIONS AND/OR WARRANTIES NOT INCLUDED
WITHIN THE TERMS OF THIS AGREEMENT. NO PERSON OR ENTITY IS AUTHORIZED TO
MAKE ANY OTHER REPRESENTATION OR WARRANTY, OR TO ASSUME ANY OBLIGATION
ON BEHALF OF JB RACING PRODUCTS. THE REMEDIES OF PARTS REPAIR OR
REPLACEMENT ARE THE ONLY REMEDIES AVAILABLE UNDER THE LIMITED WARRANTY.
IN NO EVENT SHALL JB RACING PRODUCTS BE LIABLE FOR ANY DIRECT, INCIDENTAL,
SPECIAL, OR CONSEQUENTIAL DAMAGES, WHETHER ARISING OUT OF CONTRACT,
WARRANTY, AND/OR TORT (INCLUDING, WITHOUT LIMITATION, NEGLIGENCE; IMPUTED
LIABILITY; OR STRICT LIABILITY) OR BY STATUTE OR OTHERWISE (INCLUDING, BUT NOT
LIMITED TO, LOSS OF PROFITS, LOSS OF GOODWILL, LOSS OF USE, LOSS OF TIME,
INCONVENIENCE, LOSS OF VALUE, OR COMMERCIAL LOSS).

Purchaser and JB Racing Products agree to be governed by Florida law and consent to personal
jurisdiction and venue in a court of competent jurisdiction located in Orange County, Florida. Purchaser
and JB Racing Products agree that because any controversy relating to parts supplied by the company
involve complicated and difficult factual and legal issues, any action brought, alone or in combination
with others, shall be determined by a judge sitting without a jury. The prevailing party shall be entitled to
recover from the non-prevailing party all attorney fees, paralegal fees, and costs incurred, including all
costs of appeal or otherwise.
